Wisconsin Law Journal reports about Class Action case against Healthport and Aurora Health Care
HEALTHPORT CLASS ACTION WISCONSIN
The Wisconsin Law Journal featured our clients Healthport Class Action lawsuit last week.
Welcenbach Law Offices, on behalf of their client, Carolyn Moya, brought a class action suit against Healthport Technologies and Aurora Healthcare alleging she was overcharged to obtain her own medical records.
The case is currently pending before the Wisconsin Supreme Court. Last week, the Wisconsin Law Journal ran a feature article about the case on the front page of the newspaper.
Ms. Moya brought suit and alleged that when she provided a HIPAA release to her attorneys, that the medical provider could not charge certification or retrieval fees under Wisconsin Law. Three circuit Court judges agreed with Moya and Healthport appealed. The Court of Appeals, overturned the trial court and ruled in favor of Healthport holding under Wisconsin law that personal injury attorneys that request records with their client’s permission are not exempt from the fees.
Moya then petitioned the Wisconsin Supreme Court who accepted review and will now decide the case.
